Sale of Property in France

 

1. Jurisdiction and Applicable Law

This property is located in France. The sale is subject to French law and must be formalized through a licensed French notary (notaire). The notary is a public official who acts as a neutral legal authority, ensuring that all aspects of the transaction comply with French legal requirements and that both parties are protected.

2. Property Status and Sale Conditions

The property is sold as is, meaning in its current condition, with no obligation on the part of the seller to carry out repairs or upgrades. The buyer accepts the property in its present state, including any visible or latent defects.Unless otherwise agreed in writing, the property is sold unfurnished and vacant of all occupants.

 

3. Transaction Costs

In addition to the agreed sale price, the buyer will be responsible for all standard transaction costs under French law. These include:

  • Notary fees and legal registration costs

  • Government taxes (transfer duties)

  • Any personal legal, financial, or translation services

These costs generally represent approximately 7–8% of the purchase price.

 

4. Non-Resident Buyers

There are no restrictions for non-residents purchasing property in France. The process is straightforward and fully manageable from abroad.

  • Adhering to any zoning or heritage preservation constraints imposed by the local mayor.

While these upgrades are not required prior to purchase, they may become mandatory over time depending on local regulations or future renovations.

 

7. Legal Assistance

A licensed French notary (notaire) will oversee the entire transaction. In France, the notary acts as a neutral public official, legally bound to protect the interests of both the buyer and the seller. The notary is responsible for drafting the purchase agreement, verifying property titles, ensuring compliance with applicable laws, collecting taxes, and registering the deed.

Although it is not necessary to involve any other parties, buyers may, if they wish, engage their own independent legal counsel or real estate agent, either in their home country, in France, or both.

However, because the notary's role is both comprehensive and impartial, retaining additional representation is a personal choice rather than a legal requirement.
